1. General Terms and Conditions

1.1. The present General Terms and Conditions of Sale apply to all Internet orders for one or more Tourist Products placed by the CLIENT with the OPTM Internet Ticket Office. Said Tourism Products may only be used for the day(s) chosen by the CLIENT when placing the Order.

These General Terms and Conditions can be consulted on the website.

1.2. The CLIENT declares that he/she has the legal capacity to enter into the present contract, i.e. has reached the age of majority and is not under guardianship or trusteeship.

1.3. The placing of an Order implies the express and unreserved acceptance by the CLIENT of all the clauses and conditions set out in these GCS. Consequently, the CUSTOMER declares and acknowledges that he/she is fully aware of them, and hereby waives the right to rely on any other document.

1.4. OPTM reserves the right to unilaterally modify these GTS at any time, and to apply them to all Orders placed after the date of modification.

1.5. The fact that OPTM does not avail itself of any of the present conditions during a given period may not be interpreted as a waiver of the right to avail itself of the said condition at a later date or, more generally, of the other conditions.

1.6. Notwithstanding the terminology that may be used, these GTS apply to the provision of services and are not intended to effect any transfer of ownership whatsoever, so that none of these provisions may be interpreted as constituting a sale.

2. Orders

2.1. Orders for Tourism Products are subject to the present General Terms and Conditions of Sale and to the site’s internal regulations.

2.2. To place an order, each CUSTOMER must be identified after having created a secure account (login and password).

After logging in, the CLIENT will fill in the form with details of the services required.

Before definitively registering an order, the CLIENT will be able to check his selection (order) and modify it at his convenience.

The order will not be definitively registered until the third and final validation of the order summary screen. This last “click” is assimilated to the handwritten signature referred to in article 1341 of the French Civil Code (hereinafter referred to as “the acceptance click”). As of the acceptance click indicated above, the order is considered irrevocable and may only be challenged in the cases exhaustively set out below. Before this last click, the CLIENT may identify any errors and correct them.

2.3. Once the order has been registered, the CLIENT’s computer will be automatically redirected to a page confirming the final validation of the order. The CLIENT will also receive a confirmation e-mail.

This validation, in one of the two forms, is valid for all access to the Park. To this end, it must be printed out by the CLIENT, who will use it in accordance with the provisions of article 2.6 herein.

2.4. The CLIENT has the guarantee that his bank account will be debited only once by OPTM via its secure payment site, for the total amount of the order for the Tourist Product, as from the definitive registration mentioned in 2.2.

2.5. All information contained in confirmation e-mails will be deemed to have been accepted by the CLIENT if he/she has not contested them by registered letter with acknowledgement of receipt within 8 days. However, they may only be contested insofar as they differ from the reservations.

2.6. By retaining and/or printing the confirmation page or e-mail sent by OPTM, the CLIENT holds proof of his/her order.

2.7. Purchased tickets for access to the Park will be printable directly by the customer via his/her own equipment, or may be requested from the relevant department at OPTM, upon arrival and presentation of the written confirmation (or e-mail) and proof of identity (national identity card of the person who made the purchase, bank card’ ), identifier and reservation date.

2.8. Since Law No. 2014-344 of March 17, 2014 relating to consumption, known as the “Hamon Law”, the CLIENT benefits from the 14-day withdrawal period. However, time-stamped tickets for an entertainment or show taking place on the terrace are not subject to a right of withdrawal in accordance with article L. 121-28, 12° of the French Consumer Code.

3. General Rules Relating to the Sale of Tourist Products

3.1. Any Tourist Product subscribed to by the CLIENT for access to the Site shall not give rise to any particular advantage in the event of affluence.

It may happen that certain activities indicated in the description appearing on the Site, are cancelled in particular for climatic reasons, in the event of force majeure or of a stay outside the tourist season.

Cancellation of any activity for reasons of force majeure or due to the behavior of a third party to the contract shall not in any event result in OPTM paying any compensation to the CLIENT.

3.2. Prices

The descriptions of the Tourist Products presented on the Internet Ticketing Service specify, for each product, the services included in the price. Prices are indicated in Euros and include all taxes, unless otherwise stated on the Internet Ticketing Service.

As a general rule, and unless expressly stated otherwise, prices do not include insurance or any personal expenses (catering, drinks, tips, etc.) and more generally any service not expressly mentioned on the Internet Ticketing Service.

Prices shown on the Internet Ticketing Service may be modified at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations previously accepted.

3.3. The only method of payment accepted for orders subject to these GTC is by credit card (Carte Bleue, Visa, Eurocard/Mastercard are accepted). Payment of the price via the Site is made directly to OPTM, using the CLIENT’s bank card number by means of a secure payment system.

3.4. OPTM will issue a summary invoice showing the date and amount of the sums paid by the CLIENT for the Tourist Product.

3.5. Cancellation and Modification

Any request for cancellation or modification of the Tourism Product by the CLIENT must be sent by registered letter with acknowledgement of receipt to OPTM, at the following address: OPTM 33, avenue du Maine – 75755 PARIS CEDEX 15.

Except in cases of force majeure, in the event of cancellation of the Touristic Product by the CLIENT, all sums paid by the CLIENT to OPTM shall be retained by OPTM without prejudice to any damages that OPTM may claim as a result of the loss suffered by the CLIENT as a result of the cancellation.

Except in the case of force majeure and through the fault of the CLIENT, in the event of cancellation of the Touristic Product by OPTM, the CLIENT will be refunded double the sums already paid for the Touristic Product.

3.6. Photos and Illustrations

Every effort is made to provide photos and illustrations that give the CLIENT an overview of the products offered.

4. Obligations of the Parties

4.1. OPTM undertakes to carry out the Tourist Product Order, subject to the provisions of Article 7 below and to the CLIENT’s compliance with the procedure set out in Article 2 above.

4.2. In the event that OPTM should find itself, after the final validation of the Order, unable to fulfill its obligations, OPTM reserves the right, in order to guarantee as far as possible a product in line with the CLIENT’s expectations, to modify the initial allocation of services provided that these correspond to the CLIENT’s expectations; should this be the case, OPTM shall inform the CLIENT in good time of any modification.

4.3. Each visitor must comply with the house rules posted at the entrance to the sites included in the Tourist Product.

4.4. The CLIENT undertakes to comply with any instructions given by OPTM concerning the organization of the Touristic Product.

4.5. No Order may be transferred by the CLIENT to a third party without prior written notification to OPTM.

5. Liability

OPTM may exonerate itself from all or part of its liability by proving that the non-performance or improper performance of the contract is attributable either to the CLIENT, or to the unforeseeable and insurmountable act of a third party unrelated to the provision of the services stipulated in the GTC, or to a case of force majeure.

5.1. The CUSTOMER will be held responsible for any damage, direct or indirect, that subscribers may cause during their presence in the OPTM Parks, whether to OPTM staff and/or customers or to any equipment made available to the CUSTOMER by OPTM.

5.2. OPTM declines all responsibility for damages of any kind. Indeed, each visitor is responsible for any damage, direct or indirect, that he or she may cause while using the Site.

5.3. OPTM cannot be held liable in any way, particularly in the event of loss or theft of a ticket. However, a duplicate ticket may be issued at the dedicated ticket office upon presentation of proof of identity, identification, and reservation date, provided that the ticket has not been used.

6. Cancellation

OPTM shall not be entitled to reimbursement for any services provided under these GTS in the event of: (i) non-use by the CLIENT under the conditions set out in article 3.5 of these GTS; (ii) weather-related reasons or exceptional cancellation of a show.

7. Force Majeure

The Parties reserve the right, without payment of any penalty or indemnity whatsoever, to cancel the execution of the Touristic Product if events of force majeure or unforeseen circumstances force them to do so.

Similarly, the management of OPTM reserves the right to modify, without payment of any penalty or indemnity whatsoever, the programming of the Tourist Product if forced to do so by events of force majeure or unforeseen circumstances.

8. Applicable Law, Claims and Disputes

8.1. These GCS are governed by French law.

8.2. Any claim arising during the performance of the services defined herein must be lodged by the CLIENT as soon as possible, on the spot, and in an appropriate manner, so that OPTM can seek a solution as quickly as possible. In any event, complaints must be sent by the CLIENT to OPTM by registered mail within one month of the date of performance of the services. This letter must specify the Order number and the precise reasons for the complaint.

9. Personal Data

9.1. The information collected on the Internet Ticketing service is intended for OPTM. It is processed electronically for the purpose of processing the CLIENT’s request and for OPTM ‘s commercial management, in particular:

– responding to requests for information made on the Site,

– placing and managing orders,

– sending commercial information when the CLIENT has given his consent or when authorized by current legislation,

– to compile general statistics on Site visits in order to improve the services offered by OPTM on this Site.

9.2. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, the CUSTOMER has the right to access, rectify, and delete any information concerning him or her. This right may be exercised by contacting OPTM, whose registered office is at 33, avenue du Maine 75755 PARIS CEDEX 15, France, the company responsible for processing the data.

This is an individual right which can only be exercised by the person concerned in relation to his/her own information: for security reasons, OPTM must verify his/her identity in order to avoid any communication of confidential information concerning him/her to anyone other than him/herself.

The CLIENT’s data may be transmitted by OPTM to third parties for commercial prospecting purposes, provided that the CLIENT has given his consent on the registration form he has filled in.

9.3. Registration form fields marked with an asterisk must be completed. Otherwise, OPTM will not be able to process the registration request.

OPTM may also collect data concerning the use of the Site, for example, the pages that the CLIENT visits or the services that the CLIENT uses, in order to better understand the CLIENT’s expectations and to improve the operation of the Site. If the CLIENT does not wish this, he/she may refer to the “cookies” section of this legal information.

9.4. Personal Account

The CUSTOMER’s name and password assigned to him when he registers for the creation of a personal account are personal and confidential.

OPTM may, however, have access to the offers that the CLIENT selects in his/her personal account and study them in order to better determine the CLIENT’s expectations and needs.

When the CLIENT connects to his/her personal account, a cookie is placed on his/her computer to facilitate the use of this account. If the CLIENT does not wish this, he/she can refer to the “cookies” section of the present legal information.

9.5. Cookies

OPTM uses cookies, which are files transferred to the CLIENT’s computer, but which do not allow the CLIENT to be identified. Cookies record information relating to the computer’s browsing of the Site (pages consulted, date and time of consultation, etc.) and enable it to be extracted during subsequent connections to the Site in order to personalize the CLIENT’s connection.

This data may be stored on the computer until the reservation date.

The CLIENT may refuse to accept cookies by configuring his/her computer according to the browser he/she is using. The browser’s “help” section may indicate how to refuse cookies. By way of example, the functions provided by certain browsers are as follows:

For Microsoft Internet Explorer 6.0:

Access and use of the Site are subject to the present “Legal Notice” detailed below as well as any applicable laws/regulations. Rules and Regulations

Internal regulations governing conditions of access to the Panoramic Observatory of the Montparnasse Tower

These rules and regulations apply to individual and group visitors to the Panoramic Observatory of the Montparnasse Tower (hereinafter referred to as the “OPTM”).

For your safety and to ensure that you have a pleasant visit, we ask you to respect the following rules.

1. SITE ACCESS

1.1. Access control

For security reasons, entry to the site is subject to visual inspection, or the use of special equipment, of visitors’ clothing, coats, bags, and personal belongings, in accordance with the “Vigipirate” system.

In the event of refusal, OPTM reserves the right to deny access to the site.

It is also forbidden to bring onto the site any objects that represent a risk to the safety of persons or the building, and in particular:

– Illegal, dangerous, explosive, flammable or volatile substances;

– Dangerous objects, in particular weapons, ammunition, and knives of an offensive or defensive nature, whatever their category. Also excluded are any type of object or toy having the appearance of a weapon (e.g. laser gun, water pistol, dummy gun, or knife, etc.) likely to endanger the safety of visitors;

– Alcoholic beverages or glass bottles;

– noisy objects likely to disturb the peace and quiet of visitors (vuvuzela, voice boxes, horns, whistles);

– Any other object that the OPTM considers inappropriate or likely to disturb the smooth running of the visit and the peace and quiet of visitors (parachute/canvas/tarp/banner etc).

1.2. Bulky objects

As OPTM has no on-site lockers, its employees are not authorized to store visitors’ personal belongings, which must be kept with them. Heavy or cumbersome objects are therefore prohibited.

Strollers and small carts are permitted.

1.3. Moving Equipment

It is forbidden to enter the site and/or use roller skates, bicycles, scooters, or any other moving equipment, whether motorized or not.

If a person’s state of health so requires, they may use a wheelchair, whether motorized or not.

1.4. Dress Code

Proper attire is required at all times. Visitors must wear shoes, tops and bottoms. Access to the site may be refused if these dress requirements are not met.

1.5. Minors

Children under the age of 16 must be accompanied by a parent or responsible adult in order to purchase an admission ticket and gain access to the site. They must be under the constant supervision of these persons, who are then responsible for any damage they may cause.

1.6. Pets

Small animals may be allowed on site, in their owner’s bag.

Animals used to accompany disabled persons are permitted.

Animals must be kept on a leash and under the care of their owner.

1.7. Validity of Admission Tickets

Visitors undertake to check and respect the validity of the ticket that gives them access to the site.

2. SAFETY AND HYGIENE INSTRUCTIONS

2.1. General Behavior of Visitors

Visitors undertake to comply with all laws and regulations and to refrain from committing any criminal offence during their visit.

The OPTM reserves the discretionary right to deny access to any person whose behavior is such as to endanger the safety of the OPTM and other visitors.

Without this list being exhaustive, offenses such as insulting language, verbal or physical violence, theft, disturbance of the peace, fraud, swindling, drunkenness, offenses against public decency, discrimination or racism, malicious mischief, failure to comply with safety instructions and internal regulations, may lead the OPTM to intervene and take appropriate measures. In such cases, the OPTM will notify the police and will be free to lodge a complaint against the offender. The OPTM may remove the offending visitor from the site without compensation, reimbursement, or other recourse.

Visitors are required to respect the cleanliness of the premises and facilities set up for their pleasure and comfort.

For the comfort and safety of all, it is forbidden to eat or drink (picnics) on the site (levels 56 and 59).

2.2. Site Evacuation

For safety reasons or in the event of force majeure, OPTM reserves the right to restrict or refuse access to the site or to evacuate it.

2.3. Theft and Damage to Visitors’ Property

The OPTM cannot under any circumstances be held responsible for theft, loss, or damage to visitors’ personal belongings during their visit to the site. We recommend that no valuables are left in baby carriages.

2.4. No Smoking

The site has 2 levels: the 56th floor (inside) is non-smoking, while the 59th floor (outside) is smoking (ashtrays are available). These principles also apply to electronic cigarettes.

2.5. Video Surveillance

The site is equipped with a video surveillance system operated by OPTM. This video surveillance system is installed for the safety of people and property. The OPTM is responsible for managing the system, in accordance with current legislation and regulations.

2.6. Lost or Abandoned Items

Visitors should take care to keep their personal belongings with them during their visit.

In the event of an object being lost or abandoned, the OPTM will take the most appropriate action. Depending on their nature, and always taking into account the site’s security requirements, these objects may be kept pending a claim, or transferred to the Lost & Found department.

3. ACCESSIBILITY – Closure of the 59th floor (panoramic terrace)

The terrace may be closed due to unfavorable weather conditions or insufficient security. Visitors are informed that such closures may occur without prior notice.

4. PROHIBITION OF ANY UNAUTHORIZED COMMERCIAL ACTIVITY

4.1. Street vending and leaflet distribution

As a general rule, the sale of any goods and/or services on the site is strictly prohibited.

The resale of tickets for admission to the site is prohibited.

Similarly, the distribution of leaflets, flyers, and other printed matter or signs by visitors is strictly forbidden.

4.2. Photography, Recording, and Copying

Any image, video, sound, or photograph taken by a visitor on the site may only be used for strictly personal and non-commercial purposes unless expressly authorized in advance and in writing by the OPTM.
